Tangy Chef  LLC is a California based company that makes information, products, and services available, including on our Websites (the Site(s)), subject to the following Privacy Policy (the Privacy Policy).

  • Personal Contact Information

     

  • The information collected during these interactions may vary based on what you choose to share with us, but it will generally include name, e-mail address, telephone number, account credentials, demographic data (such as gender, race, and country), your delivery address, other profile data (such as your preferences and favorites), the content of any message you send to us or reviews and feedback you submit about Sellers’ Meals that may be publicly posted on the Service at Seller’s discretion, and the financial information necessary to ensure payments can be processed by our payment processor Stripe, Inc. (“Stripe”). Accordingly, in addition to this Privacy Policy and our Terms of Service, information related to your purchases is also processed according to Stripe’s services agreement and privacy policy. We collect the content within any messages exchanged between users and Sellers through the Service (such as if you use our chat functionality). We also collect data about your personal contacts, including the first and last name, email address, and phone number of your personal contacts. We collect data about your contacts with your consent and in order to fulfill a request by you, such as inviting your contacts to join the Service. Such functionality is only intended for U.S. residents. By using this functionality, you acknowledge and agree that both you and your contacts are based in the U.S. and that you have your contacts’ consent for us to use their contact information to fulfill your request. The personally identifiable information we collect when you place an order or register for membership on our Site may be used for any of the following purposes:

 

• To fulfill your requests for products and services;
• To notify you of order, delivery, and shipment statuses;
• To provide you with offers from Tangy Chef;
• To contact you when necessary;
• To review Site usage and operations;
• To address problems with the Site, our business or our products and services; and
• To protect security or integrity of the Site and our business.

Information we collect through our Social Media Pages: We have pages on social media sites like Instagram, Twitter, and Facebook. When you interact with our social media Pages, we will collect the information that you provide to us, such as your contact details. Also, if you publicly reference our Service on social media, we may use your reference on or in connection with our Service. In addition, the companies that host our social media Pages may provide us with aggregate information and analytics regarding the use of our social media Pages.

 

Information We Collect When You Log-in Through social media: We may embed a pixel or SDK on our Service that allows you to log-in to your Chef account through social media. If you choose to engage with such integration, we may receive information from the social media platform that you have authorized to share with us. Please note that the social media platform may independently collect information about you through the integration.

Information We Receive automatically from Your Use of the Service: When you visit, use and interact with the Service, we may receive certain information about your visit, use or interactions. For example, we may monitor the number of people that visit the Service, peak hours of visits, which page(s) you visit, which links you click, what text you enter, how your mouse moves around the Service, the domains you come from (e.g., google.com, facebook.com, etc.), and which browsers you use to access the Service (e.g., Google Chrome, Firefox, Microsoft Internet Explorer, etc.), broad geographical information (such as location derived from an IP address or data that indicates a city or postal code level) and precise location data (such as latitude/longitude data when you enter you address for a Meal delivery), and navigation patterns. In particular, the following information is created and automatically logged in our systems:

Log data: Information that your browser automatically sends whenever you visit the Site (“log data”). Log data includes your Internet Protocol address, browser type and settings, the date and time of your request, and how you interacted with the Site.

 

Device information: Includes name of the device, operating system, internet service provider, your device’s regional and language settings, device identifiers (e.g., IP address), and browser you are using. Information collected may depend on the type of device you use and its settings.

 

Usage Information: We collect information about how you use our Service, such as the types of content that you view or engage with, the features you use, the actions you take (including the Meals you view and purchase), the emails you view, and the time, frequency and duration of your activities.

Information We Receive from Other Sources: We collect information from (i) data brokers, from which we purchase data to supplement the data we collect; (ii) partners, who offer co-branded services, sell or distribute our products and services, or engage in joint marketing activities; and (iii) publicly-available sources, including data in the public domain.

 

Information We Collect if You use the Service as a Seller: If you sign up to be a Seller on the Service, we collect information about you such as your first and last name, email address, telephone number, postal address, account credentials, financial information, and other information collected by our service provider(s) who assist with providing the Service for Sellers. We use this information to create and administer your Chef account and facilitate communications between you and individuals who purchase Meals from you through the Service.

 

Cookies: We use cookies to operate and administer our Site, gather Usage Information on our Site, support security features, bring you advertising off the Service, and improve your experience on it. A “cookie” is a piece of information sent to your browser by a website you visit. Cookies can be stored on your computer for different periods of time. Some cookies expire after a certain amount of time, or upon logging out (session cookies), others survive after your browser is closed until a defined expiration date set in the cookie (as determined by the party placing it), and help recognize your computer when you open your browser and browse the Internet again (persistent cookies).

 

Pixels: We use pixels (also known as web beacons), which is code embedded in a website, video, email, or advertisement, to send information about your use of the Service to a server. There are various types of pixels, including image pixels (which are small graphic images) and JavaScript pixels (which contains JavaScript code). Analytics: We use analytics services, such as Google Analytics, a web analytics service provided by Google, Inc. These analytics services use cookies to help us analyze how users use the Site and enhance your experience when you use the Site. Online Tracking and Do Not Track Signals: We and our analytics and advertising providers, including Facebook, may use cookies, pixels or other tracking technologies to collect information about your browsing activities over time and across different websites following your use of the Site and use that information to send targeted advertisements. For example, we place ads through Google and Facebook that you may view on their platforms as well as on other websites and services.

How we may collect your information:

We collect and use information for business and commercial purposes in accordance with the practices described in this Privacy Policy. We use the information we collect for the following business purposes:

 

• To provide the Service, including the online marketplace in which Sellers can sell food items and meal orders to customers (each, a “Meal”) and customers can rate and provide feedback on those Meals;
• To respond to your inquiries, comments, feedback or questions;
• To facilitate your orders on the Service;
• To send administrative information to you, for example, information regarding the Service, requests for feedback, and changes to our terms, conditions, and policies;
• To analyze how you interact with our Service;
• To maintain and improve the content and functionality of the Service and other Chef websites, apps, marketing efforts, products, and services;
• To develop new products and services;
• To prevent fraud, criminal activity, or misuses of our Service, breach of our policies and terms, and to ensure the security of our IT systems, architecture and networks;
• To conduct promotions, including verifying your eligibility and if applicable, delivering prizes in connection with your entries.
• To comply with legal obligations and legal process and to protect our rights, privacy, safety or property, and/or that of our affiliates, you or other third parties;
• To fulfil any other purpose at your direction; and
• With notice to you and your consent.

Aggregated or De-Identified Information. We may de-identify and aggregate data collected through the Services and use it for any purpose. This information will not identify you individually.

 

Marketing: We do not rent, sell or share your Personal Information with nonaffiliated people or companies, such as ad networks, for their direct or indirect marketing purposes, but we may use Personal Information and Usage Information for our own marketing purposes. We may use your Personal Information and other information to communicate with you by email, text messages, or push messages to provide you with information we think may be of interest to you. We will send you text messages only with your consent, which we will ask for at the time you provide us with your mobile telephone number, and you may opt out of emails by using the opt-out mechanism provided. You can opt-out of receiving text messages or calls to your phone number at any time by (i) for text messages, texting “STOP” in response to any text message you receive from us; and (ii) for calls, requesting opt-out during any call you receive from us. In addition, if at any time you do not wish to receive future marketing communications via your email address or telephone number, you may contact us at privacy@tangychef.com. If you unsubscribe from our marketing lists, you will no longer receive marketing communications but we may still contact you regarding management of your account, other administrative matters, and to respond to your requests.

How we may disclose your information:

We may share data with third parties for the following business purposes:

 

Within Tangy Chef, and with our affiliates: We may share your information within our company and our subsidiaries and affiliated companies for the purposes of decision making, reporting, management, analysis, promoting product and service offerings, and other business purposes.

 

Service Providers: We may share your information with our service providers who provide us support services such as hosting our website, postal delivery and electronic mail, mobile messages, product and service delivery, conducting analysis to improve our products and website, fulfilling orders you place, managing payments, and answering your questions. Service providers only use the information they receive from us for the purposes we hired them for; we don’t allow them to retain, use, disclose, or otherwise handle the data for their own purposes.

 

Marketing Partners: We may share your information to display online, mobile, or other advertising based on your purchases, activity on websites and mobile apps, and preferences you share with us so we can provide you with promotions and special offers that may interest you. We may also share information with marketing partners to help us analyze data and provide more relevant, personalized communications to you, sometimes combined with other sources.

 

Third-Party Sites and Services: We may share your information to develop and provide special services or offers that may interest you. When we share information with third parties, we require those third parties to handle the information in accordance with relevant laws. We may also share your information in an aggregated way that doesn’t directly identify you but can be used for statistical analysis and other business purposes. We may also share your information where you intentionally interact with a third party, such as where you click on a link to a third-party website, product, or service from our website, products, applications, or services. We may also help you establish your own direct relationship with another party. For example, if you order from us you authorize Tangy Chef to exchange the information you provide during the order process to that third-party to carry out that service. In these cases, we may help you transfer some of your information needed for that service, just so you don’t need to manually retype it. In these cases, we’ll continue to comply with this Privacy Policy for the data we hold, but it is important for you to remember that you have established a separate relationship with that third party and will be subject to their privacy policies. Tangy Chef is not responsible for the privacy practices of third parties.

 

With Third Parties, including Governmental Authorities, for Lawful Purposes: We may share your information where we believe the disclosure is required by law or otherwise necessary to comply with the law, regulatory requirements, requests from public authorities, or to enforce our agreements or policies, to protect the rights and property of our customers, the company, our partners, or the public (including for fraud prevention purposes). Additionally, your information may be shared if Tangy Chef or a business unit or any of its assets are sold to another company, such as in a merger, acquisition, or other corporate reorganization, in which case we’ll maintain our current Privacy Policy until data is transferred to that new company and data is covered by their privacy policy.

 

Notwithstanding the above, we may share information that does not identify you (including information that has been aggregated or de-identified) except as prohibited by applicable law. How we secure your information:

Protecting your information from unauthorized disclosure is extremely important to us. We use the industry standard technology to protect the security of your information. The Internet cannot be guaranteed to be entirely secure, however, and therefore we cannot ensure or warrant the security of any information you provide to us or accept liability for unintentional disclosures.

 

By using the Services or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Services. If we learn of a security systems breach, we may attempt to notify you electronically by posting a notice on the Services or sending an email to you. California defines Personal Information as information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

 

If you live in California, you have some additional rights with respect to certain Personal Information we collect about you. This includes:

• Get a copy of Personal Information that we’ve collected from or about you no more than twice every 12 months
• Learn about the kinds of third parties with whom we may’ve shared your Personal Information
• Obtain the categories of Personal Information that we may’ve sold or otherwise shared in the past 12 months
• Learn about the categories of third parties we may’ve sold your Personal Information to
• Request that your Personal Information be removed from our systems
• Opt out from our sales of your Personal Information
• Lodge complaints about the way we handle your Personal Information
• Not be discriminated against for exercising your rights under this Privacy Policy

 

You can make requests to receive copies of Personal Information and to have Personal Information deleted on behalf of members of your household by submitting requests on their behalf along with written authorization from each member of your household.

 

You can also submit requests through an agent (like a membership organization you belong to, your attorney, or someone else you trust) that you have authorized in writing to act on your behalf. To do so you’ll need to either present a power of attorney for them to act on your behalf or give your agent your written and signed permission to do so.

 

Either way, we’ll need to verify your identity if you want copies of your Personal Information, to know about what categories of Personal Information we collect and sell, or to have your Personal Information deleted. We’ll ask you to provide several data points like name, address, and account number to match against the information we have in our systems. We have this process so we can verify the identity of the consumer making the request to a reasonable degree of certainty as detailed in the California Consumer Privacy Act (CCPA). We want to be sure that we’re returning potentially sensitive information about you or the things that you buy on our website only to you or your agent authorized to receive it. If we can’t verify your identity, we’ll have to reject your request. Otherwise, we’ll notify you when your request has been completed. In accordance with the CCPA regulations, we won’t disclose certain sensitive information in response to a request for access to specific pieces of personal information, including financial info and account passwords.. If you’re making requests on behalf of your household, we’ll also need to verify the identities of each member of your household.

 

To exercise these rights, contact us through one of the methods described in “Contacting Our Privacy Program” below. Requests are generally free of charge, and we’ll generally process your request within 45 days unless we have a specific reason for an extension of time. If for any reason we can’t fulfill your request in whole or in part, we’ll also let you know.

Children privacy:

 

Our Service is not directed to children and is intended for a general audience. Tangy Chef does not knowingly collect personal information (as defined by the U.S. Children’s Online Privacy Protection Act, or “COPPA”) from children. If you learn that your child has provided us with Personal Information without your consent, you may alert us at privacy@tangychef.com. If we learn that we have collected any Personal Information from children under 13, we will promptly take steps to delete such information and terminate the child’s account.

The Service may contain links to other websites not operated or controlled by Tangy Chef, including social media services. The information that you share with and that is collected by these other parties will be governed by the specific privacy policies and terms of service of the other party and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the other party directly for information on their privacy practices and policies.

Business transition including merger or acquisition:

 

If the Company undergoes a business transition such as a merger, being acquired by another company, or selling a portion of its assets, your Usage Information and Personal Information may become part of the assets transferred.

 

Changes to our privacy policy and practices:

 

Posting of Revised Privacy Policy. We may update this Privacy Policy to reflect changes in our business and to our information practices. If we make any change in how we use Personal Information, we will notify you by placing a prominent notice on the Services prior to the change becoming effective. *

We may require additional information from you to allow us to verify your identity and are only required to respond to requests once during any calendar year.
